Terms of Service

1. Acceptance of Terms

By accessing or using Apex ("the Service"), provided by Genesis Technology, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Apex provides AI-powered media authentication tools that analyze images and video for signs of synthetic generation or manipulation. Analysis results are probabilistic — they are not definitive legal or forensic conclusions. Apex also issues post-quantum cryptographic provenance certificates for submitted media.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use at support@genesiswm.net.

4. Acceptable Use

You agree not to:

Submit illegal, harmful, or abusive content for analysis
Use the Service to analyze child sexual abuse material (CSAM) or any illegal imagery
Attempt to reverse-engineer, scrape, or systematically extract data from the Service
Use automated tools to exceed your plan's scan limits or circumvent rate limiting
Misrepresent analysis results — Apex certificates are probabilistic tools, not legal proof of authenticity or inauthenticity
Share your API keys with unauthorized third parties
Use the Service in any way that violates applicable law

5. Subscription Plans and Billing

Apex offers free and paid subscription tiers. Paid plans are billed monthly through Stripe. Scan limits reset on the first day of each calendar month. Unused scans do not roll over. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial months or unused scans.

6. API Usage

API keys are issued for programmatic access to the Service. API key usage is subject to the same scan limits as your subscription plan. We reserve the right to revoke API keys that violate these terms or that are used to abuse the Service.

7. Intellectual Property

You retain all rights to the media you submit. By submitting media, you grant Genesis Technology a limited, non-exclusive license to process that media for the sole purpose of providing the analysis service. We do not claim ownership of your content and do not use it to train AI models.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. GENESIS TECHNOLOGY DOES NOT WARRANT THAT ANALYSIS RESULTS ARE ACCURATE, COMPLETE, OR FIT FOR ANY PARTICULAR PURPOSE. MEDIA AUTHENTICATION IS A PROBABILISTIC PROCESS — RESULTS SHOULD NOT BE USED AS THE SOLE BASIS FOR LEGAL, EDITORIAL, OR FORENSIC DECISIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENESIS TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES RESULTING FROM INCORRECT ANALYSIS RESULTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms, at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including sections 7, 8, 9, and 11) will remain in effect.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sarasota County, Florida.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or a notice in the product. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
